First of all, Thank you for the positive response to the first blog of mine. I was overwhelmed with so much love and support. And then My Junior (Lakshita Singh ) accomplished and told me that - "Didi aap fundamental rights pr likho and I decided to write about it and make it simple as much as I can."
I decided to write about it because "My inspiration mentioned that you should write what your readers want to read."
What are the fundamental rights?
The fundamental rights are provided by the Constitution to secure the well being of the people and to provide better living standards.
Except for Article 21, every right is suspendable in the case of National Emergency.
So here is the Basic Fundamentals Rights of Human.
1.Right to Equality (Article 14-18)
2.Right to Freedom (Article 19-22)
3.Right against exploitation ( Article 23-24)
4.Right to Freedom of Religion ( Article 25-28)
5. And Cultural and Educational Rights ( Article 29-30)
6.Right to Constitutional Remedies (Article 32)
Here, I will be explaining the most important rights of human. I will try to explain all of those in my other upcoming blogs. If you guys prefer.
Important - 1. Article 21 - Right to life
Explanation-
Right to Life (Article 21) is included in the Right to Freedom (Article 19-22). And Right to Life is the most important right in the Constitution.
Right to life doesn't only stand to breathe, it clarifies a shelter to live, proper educational facilities (compulsory under Article 21A), proper living environment and medical care.
Even In the case of National emergency, it can't be suspended. If a person has executed the unlawful action, his or her life can't be suspended at the same time because his or her death will require the procedure established by the law.
*Article 21 implies on the Indians, as well as on Foreigners.
*Along with Article 21, there are certain provisions of Article 19 & 32 which remains unsuspended even in the case of National Emergency and requires procedures of Supreme Court.
Important - 2. Article 14 to18- Right to Equality
Explanation -
Right to Equality explains the EQUALITY BEFORE THE LAW, which means in the eyes of the law every person must be considered equally. There shall be no discrimination on the basis of religion, caste, race, gender, or place of birth.
Article 15 of the Constitution states that no citizen of India shall be discriminated on the basis of religion, caste, race, sex or place of birth.
Article 17 of the Constitution states the abolition of Untouchability. Hence, Untouchability is a crime.
And hence punishable in accordance with the law.
Considering an example - You and your friend desire to have an admission in the same college.
You both have the same marks and good grades and hence you both are eligible for the admissions.
But your friend is from another place and is having a dark colour. So his or her admission got cancelled. So the one who has cancelled his or her admission is punishable in the eyes of law.
Important -3. Article 32 - Right to Constitutional remedies.
Explanation -
This right is considered as heart and soul of the constitution by Respected Dr B.R. Ambedkar.
This right provides the right to move to the Supreme Court and as well as the High Court to secure his or her fundamental rights.
Article 32 provides the security of fundamental rights in the Constitution.
Consider if anyone of your right gets exploited by anyone. You have the right to litigate that person under Article 32 to secure your right, Under 5 writs.
Article 32 is the backbone of the Constitution.
Nonetheless, Article 32 can be suspended under the situation of the National Emergency, accordance with the procedures of Supreme Court.
